A fresh start. Give up all your assets, and in exchange eliminate your debts. Of course, you don't give up "all of your assets" in Chapter 7. • FORECLOSURE

The filing of a bankruptcy case provides an automatic stay to all collections against you, including foreclosure. You can temporarily stop a foreclosure (trustee's sale) in Chapter 7 or impose a permanent, sustainable solution on your creditors in Chapter 13.

NEWS

  • So this is what it's come to.

Oct. 2010: This family turned their home into a boarding house to keep it. Actually, this was really smart.

  • Foreclosures not stopping.

Oct. 2010: Banks took nearly 300,000 homes in the third quarter of 2010. Now what?

  • Governor signs weak, useless foreclosure protection bill.

Oct. 2010: Gov. Swarzenegger signed into law a bill that will forbid first mortgage holders from pursuing mortgage deficiencies following short sales. This sounds great, except that most first mortgages on primary residences are already without recourse, which means that the mortgage holder can't pursue you anyway. In other news, the governor vetoed a bill that would provide the same protection to people who refinanced their purchase money mortgages.
